Public Liability Insurance provides cover for bodily injury or property damage to a third party that occurs while conducting your professional activities.

Unlimited Retroactive Cover is cover for your past practices if you have had continuous Professional Indemnity cover. Otherwise, if you have had a break in your insurance, your cover starts on the day you commence a policy with BMS Group.
Run-Off Cover is if during the period of insurance you permanently retire or permanently cease practice of your professional services, your policy will provide ‘Run-Off Cover’ for an unlimited period of time. This benefit can be activated for no additional premium, but only applies if you are permanently ceasing practice. If you are ceasing your practice for the short term due to COVID-19, we would recommend you continue to maintain your current cover to ensure you remain protected.

What happens if I already have coverage in place?

Medical Malpractice Professional Indemnity Insurance (PI) protects you against liability or allegations of liability for financial injury or damages that have resulted from a negligent act, error, omission, or malpractice that has arisen out of your professional capacity as a Complementary Therapist. PI protects Complementary Therapists by ensuring that your legal defence is coordinated and paid for if a claim is made against you. Your PI also covers the cost of patient compensation or damages.

We’ve all had that moment; where you think of a brilliant business idea only to find someone has already beaten you to it. Coverage provides reimbursement to an insured member for defence costs if any criminal proceedings are brought against them in relation to the performance of their professional services rendered in Australia; provided the member is acquitted or found ‘not guilty’ of the criminal charge.
Public Relations Expenses
Reputation can mean the success or failure of a business. As an IICT Member participating in the Insurance Program, you have access to cover for costs involved with engaging a Public Relations Consultant, to work with you to maintain your public image where an allegation is made regarding the quality of your professional services which may lead to a claim.
Advance Claim Protection
Coverage is provided for an insured member to engage preliminary legal services and advice prior to an incident being formally accepted as a claim under the policy.
Are you a practice owner?
A Pilates Instructor employed by you runs a Reformer Pilates class. A participant in the class claims that inadequate supervision of class participants led to them sustaining a back injury.
The patient takes action out against the employee who ran the class, you (the Individual) as the owner of the studio who provided the treatment, and your Pilates Studio (business entity) for not having adequate processes in place to ensure adequate supervision.
Your IICT Insurance Policy responds to your legal costs to defend your liability, and if entity coverage is taken, your IICT policy will also respond to cover the legal defence costs in respect of your business entity.
It is important to note that you IICT policy will not respond to any costs associated with the action against professional employees, they will need to maintain individual Professional Indemnity coverage.

Medical Malpractice Public Liability Claim Example:
A Pilates Instructor runs small group Pilates classes out of their studio. In an earlier class a client spilled some water on the floor from their water bottle and did not bring it to the Instructor’s attention. As the next group prepare for the class in the room, an elderly participant slips on the wet floor, causing the patient to fracture their hip. Action is taken by the patient against the Pilates instructor and it is found through investigation that the Pilates Instructor was negligent as they should have checked the room for any hazards prior to the next class starting. They are found liable for the damages and their Medical Malpractice Public Liability policy responds to pay.
Products Liability Claim Example:
A Complementary Therapist sells essential oils to their clients. The essential oils are made by the Complementary Therapist. Due to the sale of undiluted essential oils, they receive a complaint from a patient about burns to their arms and neck. Action is taken out against the Complementary Therapist for the supply of a dangerous product, and their Products Liability policy responds to defend them and pay any settlement.

Cyber Security & Privacy Liability Claim Example
A Pilates Instructor Studio’s network was infected with a virus that was received via a phishing email which was opened by an employee by mistake; this allowed the hacker to gain access to the clinic’s website.
The Studio’s Cyber Liability Insurance responds to cover forensic IT costs to determine the extent of the breach and loss to data, Forensic accounting to determine any interruption to operations and loss of income, costs to remove the virus and to reinstate the insured’s data and systems. The total expenses incurred were $17,000.

The lawyer may consider it appropriate to review the issues and jurisprudence, and then call you back. The advice given will rely upon the accuracy and completeness of the information you provide.
If the event has triggered a claim the leading Allied Health law firm will be appointed as legal counsel to work on your behalf. In the event you do not wish to use the recommended law firm or if the case has a conflict you will be able to retain alternative legal counsel.

Yes. The IICT PI Insurance Policy provides unlimited retroactive cover provided that there are no known and unreported circumstances that may lead to a claim.
Should I consider this cover if I work in the Public Health Sector?
Yes. As a Public Health Sector worker, without your own insurance policy you are relying on your employer’s Insurance, which may be geared more towards protecting your employer. Further, Public Hospitals or Health Centres typically carry policy excesses upwards of $250,000; which means that, in the event of a claim against you, they may decline to cover you. Your employer’s policy may not cover you for:
- Your services with previous employers.
- Your private practice work.
- Your past services rendered.
- Your services provided as a contractor, sub-contractor or consultant.
- If you are sued by your employer.
- Legal support for regulatory inquiries, disciplinary hearings and coronial enquiries.
IICT members who participate in the Insurance Program also have peace of mind that they have an individual $20,000,000 limit covering their interests as well as access to 30 minutes of free legal assistance with a senior lawyer for each potentially claimable issue that arises. Having your own individual policy ensures you are covered if you want to work while transitioning from one employer to the next.

Clinic Package Clinic Package Insurance is designed for Allied Health & Medical businesses with assets not exceeding $5 million. It covers various general elements of business risk relating to property and interruption to operations; it is comprised of 2 main sections of cover being Material Damage and Business Interruption. Cyber Security & Privacy Liability Cyber Liability coverage responds to various losses resulting from but not limited to, stolen credentials, malware, phishing and social engineering and insider threats. Coverage is provided for loss suffered by your business, claims made by third parties affected and for your business interruption in the event of a breach. Personal Accident Personal Accident insurance is designed for companies (group cover) or individuals to provide coverage in the event of death or permanent/temporary disability due to injury or sickness. There are a range of benefits that the coverage extends to provide, including but not limited to rehabilitation, corrective surgery, medical expenses and child support. Benefits are paid by either lump sum or weekly throughout the benefit period for prolonged sickness or injury. This coverage is particularly important where:
- You are a sole trader or business owner and not covered by a workers compensation policy,
- You are a contractor, sub-contractor or locum and not covered by a workers compensation policy,
- You work in a high-risk industry or are off site often, or
- You do not have the financial means to support yourself in the event of a serious injury or prolonged illness.
Journey Cover Journey Insurance provides cover in the event that you are injured on your commute to and from work. This is a typical exclusion to many workers compensation policies, which would leave majority of employees uninsured and left to mange expenses should they be unable to work for an extended period of time. Corporate Travel Insurance Corporate Travel Insurance is an annual policy covering all staff and directors of a company for business travel. Cover will also respond to leisure trips taken by directors and business owners as well as associated leisure travel for employees of the business.
